Legal Question in Personal Injury in Maryland

Our parked car was damaged by a shopping cart in a grocery store parking lot in Montgomery County, Maryland. The person responsible for the damage disputes the amount we're seeking pursuant to the body shop estimate. If we file lawsuit to recover the cost of car repair and rental car, is the lawsuit a tort or a contract?
