Legal Question in Real Estate Law in Maryland

Hi ,

I am in need of advice on what I can do to get power run to my lot in Maryland. Delmarva Power had laid out how they planned on supplying new service from a power pole across the street from my driveway.Then they found out that the power pole was was in a easement that was specific in detail and didn't allow them to hook up to it. The easement is from around 1940. Delmarva Power is telling me; that it's up to me to contact all possible land owners and see if they will sign an easement. As they have tried and no one will grant them an easement. Stumped what can be done ?

I'm not sure if someone has answered this question already or not -- interesting question. I would need to see a survey of your property and the surrounding property in order to visualize the situation. Without having that documentation, it would be hard to advise you. There are several legal avenues that can be explored, but I would need more info. You may start by trying to contact your neighbors directly to see if they would be willing to grant you an easement. If they are unwilling, I STRONGLY recommend that you consult a Maryland real estate attorney, who can deal with your neighbors on your behalf, consult with Delmarva Power, and take appropriate legal action to get power to your property. It's not an impossible situation, but it will take some legal work to get accomplished.
