Legal Question in Real Estate Law in Maryland

Ex-husband wants me out!

My ex-husband has gotten the court to require me to sell our home. Can I sell this home to my father or to a trustee so that I can remain in the home? Does he have any say in the matter of price or to whom I may sell the home? Could I sell it to my father through a trustee (so that he would not know to whom we were selling the house) for $1 and give him his half...50 cents?

Re: Ex-husband wants me out!

If the house is jointly owned by the two of you, he obviously has a say in the price, buyer, etc. If it's just in your name, the court has apparently ruled that it's nonetheless marital property and thus you will have to sell it for fair market value or he will accuse you of waste.

If you want to remain in the home, you can buy him out--he shouldn't care as long as he gets his share of the equity from the sale.
