Security Deposit

My husband and I recently rented a small apartment close to my mother, because I am pregnant and needed help with my other small children, well it only had 2 bedrooms and we thought it would be ok until baby came, however the day my husband went and paid for the apt. the super told him that she might get in trouble because the apt. only had 2 bdrs and my children were boy and girl, well when my husband told me this we decided against renting this apt.When we contacted the owner he basicly told us our security deposit was lost, keep in mind we never moved in, the agreement that my husband signed stated that after 10 days of moving out the lanlord would give back security deposit, now we are having a hard time getting anything but the run-around from the land lord, what can we do legaly?

First of all, what you were told by the super is ridiculous. There are countless families where young brothers and sisters share a bedroom, at least until they reach a certain age. There is no way you could get "in trouble" over this arrangement.

If the landlord agreed to refund your deposit, you could sue him in landlord court and possibly recover three times your damages if he refuses to return the deposit. Go to the nearest Maryland District Court in your county and ask the clerk for landlord-tenant papers to begin this procedure. They'll usually help you with filling them out.
