Legal Question in Traffic Law in Maryland

my wife pulled out to pass a tractor trailer when it opened to a passing zone.

she got almost half way up beside it and a truck came over a little hump in

the road and

and she realized she wasn't going to make it and another car pulled up

behind the tractor trailer so as it was still

in the passing zone she pulled off the left side on the road and slowed

down. as she coasted to a crawl the lanes changed

to a non passing zone as she came almost to a complete stop. roughly 30 to

40 yards into the non passing zone the truck that was

coming swerved over the white line about three feet and hit her on the right

side of the car and spun her around into the ditch.

there are no skid marks from her car at all. there is about a 10 to 20 yard

skid mark from his truck that extends over the white line by three feet

on the shoulder. the cop wrote her two tickets one for improper passing of over taken vehicle, $130 and unsafe lane turn in no pasing zone $130. questions i have should we fight it? if we do can the raise the fines? what would she plead? does she have to have someone represent her?

No one has to have a lawyer, and in a non-jailable case, there is no right to one. However, you may have one. If your wife disputes her guilt, then plead not guilty. A lawyer will know what questions to ask and likewise which ones not to ask. Consider whether the cost of an attorney is worth it for $260 in fines.
