Worker's Comp

If an employee is in the middle of a worker's comp claim and he is seeing a chiropractor on a regular basis that he was referred to by his primary care physician - whom do we accept the list of restrictions for his ''light duty'' here at work?

As the employer, your comp carrier can elect to require the employee to undergo an independent medical exam at its expense. If the independent examiner determines that the employee has no restrictions, and he refuses to return to full duty employment, the carrier may cut off his temporary compensation benefits. The employee can then request a workers' comp hearing to determine which medical opinion should be determinative. Of course, if your work schedule can accommodate his working in a light duty capacity, you can elect to allow this.
