Legal Question in Civil Rights Law in Massachusetts

My son and 9 of his friends (aged 13-14) were questioned by police about an incident that happened in school, involving harassment of 2 teachers. Parents were not notified that the principal was contacting the authorities to question the minors. Do we have any cause of action against the school and/or the police? I would have insisted that I and my lawyer be present at the interrogation. The police threatened that charges might be pressed, and they all faced terms of up to 6 years in juvenile detention.

The best thing you can do at this point is to retain an experienced criminal defense lawyer who also has dealt with school issues too. There may be viable motions to suppress or dismiss depending on the facts and circumstances. If charges have not been lodged, the attorney may be able to convince them not to press charges.

Good luck,
