Legal Question in Credit and Debt Law in Massachusetts

Debt Collection Agency reporting to Crecit Bureaus

I ignored a debt from a hospital that went to collection. I called the collection agency in Minnesota and asked for a written verification of the debt which I never received. I ignored their letters and have now been denied a credit increase on a credit card. I was never informed that my credit rating might be affected. Did the collection agency have an obligation send me the verification and to inform me that credit bureaus would be contacted? Do I have a recourse to get my unblemished rating back? Thanks.

Re: Debt Collection Agency reporting to Crecit Bureaus

I am not certain, but I believe that reporting you when they failed to substantiate the amount owed upon your demand is illegal. You should hire local counsel and get it cleared up.

You might even be entitled to some damages, but like any threat of any lawsuit, that's better used as a threat than a reality, and it's good leverage for bargaining purposes to get what you want, which appears to be a clear credit report.

So hire an attorney there.

Good luck.
