Legal Question in Criminal Law in Massachusetts
Illegal Gun sales
In 1994 I got into a motorcycle accident where I injured my front lobe of my brain and my pitiutary gland for witch I am on life sustaining medication.I had a pistol permit for a job. I sold three 40 cal. handguns. At the time I hadnt taken my meds wich without them I was known to do bizzar and crazy things and my dr. says that without my meds I would exhibit strang and unusual behavior. I have since that time done everything in my power to retrieve the guns, including working with the ATF who promised if I helped they wouldnt charge me, they didnt MASS did, what a joke. My criminal record is pretty much clean other than some driving without a license wich accord about the same time. Is there any law that would help me, it's almost like living a life where if I dont take my meds (due to fiscal problems) another person does the crime and I do the time. I can remember everything that happened but when I think back I am like bewilderd at some of the things I have done while not on my meds. Since then I am on a strict regiment where I never miss my meds due to fiscal problems because I live with my mother now and she helps me even though she can barley keep afloat budget wise.

Re: Illegal Gun sales
There very well may be some help for you in the law. Most crimes require an intent element. If your mental state was such that you did not appreciate the wrongfulness of your conduct, it is possible you could be found not guilty by reason of the impairment. The better course is to have a decent lawyer negotiate with the ADA on the case to see if a resolution can be reached that is acceptable.
