Legal Question in Criminal Law in Massachusetts

unsupervised probation

My boyfriend was arrested and charged with unruly conduct, resisting arrest and possession of a class D this past weekend. We appeared in court yesterday and requested a pretrial date due to the charges being exaggerated and false. (I know, everyone says that). He has no prior recond for ANYTHING. So, my question is this, in September if he is not found not guilty and has to pay the fines and be on unsupervised probation - what does this mean? We have a trip out of the country already paid for and booked for November - will he be able to go? I do not know the difference, other than not having to check in with a probation officer, of supervised and unsupervised.

Re: unsupervised probation

If your boyfriend is found not guilty then of course nothing will happen to him. If he pleads guilty to the charges or is found guilty after trial and is put on unsupervised probation then his only obligation is to not commit any new criminal offenses and to notify the court of his current address. As long as he doesn't plan on moving out of the country then he doesn't really have to do anything regarding his trip. Even if he were put on supervised probation, most probation officers wouldn't give him a problem about taking a trip out of the country.
