Legal Question in DUI Law in Massachusetts

3rd offense

my first 2 were in 1990 my court date is tomorrow.my 3rd was 2006 is there any hope of them treating this as a 2nd

You never know with OUIs. They have to prove that this is a 3rd offense, they cannot simply state that it is. Your lawyer can have a separate trial on the issue of the subsequent offense and the DA has to provie it with admissible evidence. I assume you have hired an OUI specialist who would know this.
