Re: Drunk driving

Generally first OUI's need to be tried to a jury, b/c the DA won't offer any plea deal better than you would receive if you tried the case and lost. However, the recent OUI law is very favorable to defendants in certain factual circumstances. OUI not-guilty verdicts are often somewhat easier to get than many other common crimes.

Since you may need to try the case, choose counsel carefully. Feel free to contact me directly for a free initial office consultation to discuss your options further.

Re: Drunk driving

While the usual disposition for a first offense is a continuance without a finding conditioned on completing a program and paying hefty court costs and program fees, the RMV will nontheless consider this as if it was a conviction should there be a second offense.

You should, therefore, retain an attorney and speak only with that attorney about your chances of obtaining a not guilty at a jury trial.
