Legal Question in DUI Law in Massachusetts

How do i get something expunged from my record? I was told if i paid my fine and did the time it would get expunged, however I am not sure it has been and want to make sure it does. This occurred in 2003-2004 time period. I was arrested for drunk driving under age and needed to complete a course (DAE) for 16 weeks.

Unfortunately, you did not receive accurate advice the first time. It sounds like you received a CWOF which meant the oui case would be continued without a finding for a year, if you sucessfully completed probation, which it sounds like you did, the case would be dismissed (not expunged) after that year. It still counts as a first offense if you are arrested for oui again, but you may answer "no" if you are asked if you have been convicted of a crime.

Expungment is a rare remedy and is difficult to obtain, you may try, but I doubt you would be sucessfull. That is a quick explanation. Feel free to call to discuss your case further. (781) 335-0374

If this is were told, it was untrue. You could have misunderstood.

At best, it would be sealed.

For this matter, expungement is not available.
