Legal Question in Family Law in Massachusetts

My 18yr old son recently moved in with his non custodial father. Who has not been in his life. In less than 6 months, he has gone from a happy high school athlete to an angry, scruffy tatooed near high-school drop out with 22 absences. The tatoos were literally from his father. He is also smoking weed with his father. My son is 18. I also have a 13 year old. Who I very obviously want to protect. What can I do?

At the age of 18, in most circumstances, an individual is considered an adult, and custody of the individual is no longer a legal issue. There are exceptions to that rule however without more information from you I am unable to give you a more specific answer. With regards to your 13 year old child, I assume from your inquiry that you have physical custody of that child? If you do have physical custody, than you have the right to make the day to day decisions concerning the health and well-being of your child. However if there is a current court order allowing the child to see their father, and you are concerned for the well-being of your child, you should file a complaint or a motion for modification depending on the current status of your case.

I recommend that you consult with an attorney to discuss your situation specifically. If you are interested in a free consultation please contact me at 617-523-3200 or you can email me at [email protected].
