Divorce seperation of property

after I had filed for a divorce my husband sold income property for $160,000. he took this money out of the country. He sold his truck and did not work or contribute for about two years, we have now had to sell our marital home with only about $40,000. equity. Should this money be shared???

The Court can determine what is fair and equitable. If you can demonstrate concealment of other assets as you suggest, a judge is likely to give you all or most of the equity in the home. However, that may require litigation.

Absolutely. You are both entitled to any assets that were acquired in the marriage. You will also have an interest in any assets acquire prior to the marriage. The amount for prior assets may not be divided equally. You should try to obtain all records to show that he received the proceeds for these assets he sold so that you can get an order for him to pay you or levy accounts to acquire such assets. He was not entitled to sell any assets without your permission or without the permission of the court. I would suggest speaking with an attorney to make sure you get everything you are entitled to.
