Legal Question in Family Law in Massachusetts

My exhusband died before he signed papers to the house, it was going to be sold. In the divorce agreement I was suppose to get half of the money from the house. What is my next step to do?

You should consult a lawyer about your rights. You may have to sue his estate.

You need to find out if his estate has been opened yet.

If not, you may want to petition as a creditor of the estate to have the estate open.

I would contact an attorney with a copy of divorce decree and inform him of the date of death of your ex and then contact your ex's heirs.

You would Petition the Probate Court for an Order allowing the sale of the residence.

Please feel free to contact me if you have more questions.
