Legal Question in Family Law in Massachusetts

My ex husband was convicted of indecent assault and battery of a minor child. (His former step daughter) my daughter. He is currently incarcerated and is going back for retrial for the remaining counts 4 out of 7. My fiance has been reading care of my 3 children as his own and would like to adopt them. And give them his last name. How complicated is this process Sincethe ffather isn't working to coo perate

The simplest course of action would be for your ex-husband to surrender the child for adoption. If it appeases the father, it may be possible for him to retain some sort of post-adoption visitation, although I doubt he would even be entitled to that given the circumstances. You would need to file a petition for co-parent adoption in the Probate and Family Court and your ex-husband's parental rights will either need to be surrendered or terminated by the Court.
