Legal Question in Family Law in Massachusetts

I want to move out of state with my two children. I can't find any information on whether I need permission or not to do so since their biological father is uninvolved. He hasn't paid support in over a year and hasn't seen them in almost two years. Can you help?

You will need either the Biological father's permission or the courts. Given the circumstances it should not be that difficult to accomplish.

First, we need to establish whether or not there is a current custody order in place. If there is not, you may be able to leave the Commonwealth without the father's permission and without the court's permission.

Because you use the word "support", I imagine that there is a current order in place regarding the children. If that is the case, you will need either the father's permission or the courts. If you would like some assistance, please feel free to contact our office.
