Legal Question in Civil Litigation in Massachusetts

A toothpick and two surgerys later...

Premises Liability? I was hurt at a

friends home back in March of 06'

and had to have surgery twice. I

stepped on a toothpick that was

on the rug in his kitchen, and it

was so embedded that a catscan

couldn't even find it! Anyway, it

was a toothpick that he had used

earlier in the evening to eat from

and it ended up on the floor. I do

martial arts and was unable to

train for a couple of months and

the more I hear this person say

how much money he's worth and

what he'll recieve for a settlement

from his job if he's fired, is

maddening to me. I am wondering

if something called Premises

Liability would pertaing to me and

what happened in this persons

home, which is none too clean.

I concur with what Attorney Lebensbaum has said. In that regard however, a lot may depend on when and how the toothpick ended up on the floor.
