Ins. settlement - married - 50/50

If one spouse receives an insurance settlement, due to a fall inside a business, by law is the settlement shared equally by the other spouse?

Assuming you are married, theoretically the only rule is what is between the two of you. If this settlment related to a child -- it is a different ball-game. If you divorced, the divorce agreement rules, or it is an issue for a judge.

If you are married, and a spouse receives a settlement that he settling spouse is not sharing with you, what you have is NOT a legal problem, but a marital problem.
