Legal Question in Employment Law in Massachusetts

Automobile Compensation

My employer currently compensates field employees at a rate of $37.5 per mile 1-500, .26 per mile 500-1000, and .16 per mile 1000+...is this legal? Salaried employees are compensated at .31 cent per mile first to last. In Mass. this barely covers the cost of putting a car on the road with insurance and maint. not to mention the recent increase in gas prices. Is the 3 tiered system legal? and is treating employees differently based on hourly or salary compensation legal?
