Legal Question in Employment Law in Massachusetts

My company has a handbook that requires a mandatory 1hr unpaid lunch. My boss allows everyone in my department the choice to work through it and get the paid hr. accept me. I must take it unpaid. I would like to be like the others and be able to choose. Is this discrimination or against the law in Massachusetts? He is doing this on purpose to punish me for a perceived slight.

I would make a complaint to the HR department. It is not permissible to allow everyone to get an extra hour and not you.
