Pay out for earned vacation?

My company's termination policy states that upon termination, all unused accrued vacation time will be forfeited. Is this legal? We accrue vacation time on a monthly basis, so isn't it considered compensation, for this purpose?

A company is required to pay an employee for their accrued, but unused vacation upon termination. The company can have a policy that says that unused vacation is lost if not used within the year (a use it or lose it policy) but not one that says that vacation is lost upon termination.
