Legal Question in Employment Law in Massachusetts

I work in a hospital that leases the employees to the physician groups, the hospital and each physician group all have separate tax ID #s and file separate 990s. Up until today the physician group offered me some benefits and the hospital offered me some. The hospital has now stated no groups can give benefits because we are hospital employees. I have been with this physician group for 10 years and take all of my direction from the physician group. I manage there private practice and do their finances. The physician groups has much better benefits then the hospital. I believe I am the common law employee of the physician group and entitled to the better benefits. Do I have any recourse?

If the physician group wanted to employ you, it could, but you would then most likely be terminated by the hospital. My guess is that the physician group will not want to consider employing you given the hospital's position. I don't see any legal recourse against the hospital, but you should consult with other counsel to see what others say.
