Legal Question in Employment Law in Massachusetts

I worked for a developer for 20 weeks (full time) as Construction Sperintendent. I was responsible for my health insurance and taxes. He did not pay me for last 5 weeks, on Friday 10/2/2009, he decided to shut down the project and pay me $1000 check. I asked him what about the rest, he said he will pay whenever he has money. The remaining of the paymeny is around $8,000.

Will you please advise, what I have to do?

If you were an employee, you may have significant rights under the Massachusetts wage and hour laws. If not, you still may have rights in contract to collect the unpaid portion of the contract.
