Legal Question in Medical Malpractice in Massachusetts

I have had 3 knee replacements and another one pending, the first dr that put in my knee replacement in 2001, in 2007 I kept going to him saying something was wrong, I couldn't bend it,I was in alot of pain, he would send me to physical therapy multiple times finally even told him something was wrong, he didn't listen he would do knee manupulations, send me for test, my last visit with him he actually got angry with me and said "what else do you expect from me, I've done everything I can,he made me feel like I was imagining it,making it up, even my pcp was getting upset with him, so I went for 2 second opinions finally the second one said it looks infected, sure enough it was,I had staph, I had to go through torture, then a yr later I was told the put the wrong plate size in so they had to go back in re-do it again, Now I can barely walk, I can't work, now I have big bone spurs growing into my knee replacement causing pieces of bone to break off and floating around causing severe pain I'm on heavy duty pain medication so my question is that first doctor kept misdiagnoising my problem, he ruined my life, now being disabled going through another knee replacement at the age of 44,can I go after him for negligence?or something it all started with him if he just listen to me.Thanks

I'm really sorry to hear you're going through all this... Having been through 7 knee surgeries myself (2 major reconstructions), I can certainly emphasize with what you're going through, including the physical therapy and limitations on range of motion and mobility...

From your description you may have a case here, but much more information and analysis is necessary to give you clearer guidance. I will say that the situation you describe certainly warrants attorney review. I strongly recommend you consult with experienced counsel asap, as the passage of time can limit (or sometimes even cut-off entirely) rights you may have had to assert claims.

Please feel free to contact me directly for a free initial office consultation to discuss this situation. Then you can proceed as you see fit from there.

Best wishes, regardless.
