Legal Question in Medical Malpractice in Massachusetts

My mother passed away from a medical/hospital error back in 2003. We are about to go to trial in January and my family lawyer is stating that all the immediate family will be evaluated differently in terms of damages. Is this true? That doesn't seem right since we are all as one. Should I have my own attornery to represent me? I'm really confused if our attorney is representing our entire family or just my father since he controls the estate? I want to make sure that the jury understands how this case has affected me.

In a case of multiple plaintiffs, there may indeed be conflicts between their respective interests. You may be better served by having your own personal lawyer on the Plaintiff's team.
