Legal Question in Real Estate Law in Massachusetts

Election of tenents by the entirety

I would like to file a document to show that as husband and wife we are tenents by the entirety

can this be done as the deed on our home is in

wifes name alone but husband pays all costs on

the home, mortgage is in both names.A sheriffs

lien was put on this home in 1991 and I am trying

to make sure that the lien holder can not sell home.

Re: Election of tenents by the entirety

Any change in title will be recorded after the sheriff's lien. As a result, it does not affect the lien which is "first in time" The only way to deal with the lien is to pay it or possibly bankruptcy.
