Legal Question in Real Estate Law in Massachusetts

Electricity for gutter coils on Condo

We own a townhouse in MA. Over the past 3-4 years we (and other units) have had icedams and subsequest damage to the inside of the unit. While I understand that we are responsible for the inside of the unit, it was suggested that we install gutter coils. Since the gutters & roof are ''common area'' who is responsible for the electricity to run the coils?

Thanks for any assistance you can offer.

Re: Electricity for gutter coils on Condo

If the condo association is responsible to maintain the gutters as one of the common areas, it would seem they would be responsible for installing and maintaining the gutter coils to include the electricity to run them. A review of the condo agreement and bylaws might be helpful. Good Luck!

Re: Electricity for gutter coils on Condo

Refer to your condo agreements. It is quite possible that if the electrical circuits are wired into sources which service the common areas, the association may be made/ persuaded to pay it. Removing the potential ice damage may well result In reduced insurance premiums.
