if you put a fence up then find out property line is 5 feet over do you forfeit that land

No.
There is no rule that says that you must place a fence on a property line. However, if the person does something, like build or take measures to control this property, there could be a problem later.

No, it is still your land unless neighbor gains rights by adverse possession. Retain an attorney if you still have questions! Good Luck!
