Although more facts are necessary, you may have claims far more valuable than those subject to the limited jurisdiction of small claims court. Depending on the facts, you might have significant claims against not only the owner, but any broker involved, maybe the inspector, etc. The presence of mold can be serious and lead to health problems, and other concerns. Litigating this in small claims, thereby probably preventing your ability to pursue the real value of the claims, could be a serious error. You should consult with an attorney asap.
