Legal Question in Real Estate Law in Massachusetts

My neighbor's fence is on my property. I have a certified plot plan. The fence was there when I bought the property. I have spoken to the neighbor to no avail.

Boundary disputes that cannot be resolved by discussion between the parties can be resolved with an action in either the land court or superior court. If the boundary is established via a survey and finding of the court, your neighbor may still claim that they have gained ownership by 'adverse possession'... meaning that they have had the land enclosed and used it exclusively for at least twenty years.
