Town Property Taxes

After completely paying off a municipal lein for town mandated sewer connection we continute to be billed on this as an additional assesent on our town taxes. We have been to the town tax assessor and he said yes they have a record of us paying it off 2 years ago and we should just simply not pay it. We do not have that option as our taxes are paid via out mortage company. Now our mortage is increasing to cover the escrow ''needed''. What type of attorney do we need to help us ?

You need an attorney that handles banking, real estate and municipal work.

You should talk to a real estate attorney with some municipal experience. You should also ask the town to refund any excess payments made on the erroneous bill.

I would have thought talking to the Town Manager could have gotten this resolved. Please feel free to contact me if you have any more questions.

The first thing you might want to do is to get a statement from the Town concerning the current amounts due, including any betterments (e.g. sewer, sidewalk, etc.), then send this to your mortgage company, certified mail, return receipt, with a letter asking them to adjust the escrow amount going forward, and to refund any unpaid escrow overage.

Secondly, you will need to contact the town concerning procedures for recovering overpayments, and address that aspect directly with them.

A real estate attorney could assist you if you cannot resolve the matter yourself.
