Legal Question in Wills and Trusts in Massachusetts

My aunt is 98. I am her executrix.She has no real property--only cds, treasury bills, etc. Except for $90,000, all of it is either joint or has a POD. About how much would probate cost. Thank you. Irene

In Massachusetts, if the decedent had more than $15,000 in her name alone, you must file a full probate to transfer those assets. Assuming there are no estate tax issues, a simple probate would probably cost around $2,000. Remember, this is a rough estimate. You should meet with a probate attorney and ask him or her to give you a quote after reviewing the situation.

I agree with Attorney Godino. You may want to employ an estate planning attorney here in Massachusetts to evaluate your Aunt's estate and make recommendations. If there is no real property and less than $15,000.00 worth of estate property in her name alone (excluding an automobile), then there is a simplified probate process which can be employed and which should result in less attorney fees.
