father in law died leaving a $46,000.00 home equity loan

My father-in-law died leaving a home equity loan. He did not have a will and his wife predeceased him. My brother--name removed--has been paying the loan with his own money because he fears we will be responsible for additional fees and fines if payment stops while the estate is being settled.Will additional fees acrue while estate is in probate?
