I am aware of no law that says a Trust must change its name if upon the death of the Settlor his or her spouse is still alive. If Joe Smith forms the Joe Smith Revocable Trust which is called the Joe Smith Trust upon his death you do not change the name of the Trust regardless if his spouse is alive or not.
