Return of Copyrighted DVD to the store

My son received a Gamecube game as a gift for Christmas. He opened the

game and did play it for about 2 minutes and decided he didn't like it. I have

the receipt, however the store won't take it back because it was opened. We

didn't copy it, but the store says it can not take it back because it's been

opened. We went to a resale shop, they would only give $2 for a $20 game,

but they did shrink wrap it for him and said we could then try returning it to

the place of purchase. What kind of trouble can I get into by doing this? Is

this ethical?

This happens all the time. If the packaging is perfect, go ahead and take it back. Just don't say it's unopened. If they take it back, then you're sorted. Otherwise, for a $20 game, why not have your son swap with a friend or schoolmate or donate it to the libary.
