Credit Card Fraud Claim

In the month of October someone was using my credit card(I believe it was my roommate) and racked up about $3000 on it. I called my Card's fraud claim Dept. and they said they would look into it but asked who I think it might have been. I told them I think it was my roommate(who moved out right when I found out about the charges) who is also an Ex of mine that was living with me til she got her own place. They called me back 2 weeks later and told me that because the charges were made at the same stores I shop at that it could have been me that made them and just made up a story about it being stolen. And if it was her, because she was my roommate that I was responsible for the charges and that I had to pay them, because if she was making charges on it that she was probably buying stuff for the house too, so in some round a bout sort of way I was benefitting from her using my card without me knowing. And if I wanted my money I would have to take her to court because they weren't going to go after her. When I asked them why they weren't going to get the Video Footage from the stores for the times that the charges were made they simply said ''Because it wasn't worth their time''. It seems like they didn't even try to look into this.

The credit card company is likely in breach of their contract with you. Take a look at the agreement and see if you can discern what the requirements are for filing a claim and having it satisfied. If you cannot find the agreement, call the company and ask for a copy to be sent to you. Tell them you will be providing it to your attorney.

Also, you should file or at least attempt to file a police report to substantiate the claim. Write down the name, badge number, time and date, and document what is said as to all police officers with whom you speak. This way, even if they don't let you file a report, the fact that you did will provide more credibility to your story.
