Legal Question in Credit and Debt Law in Michigan

debt collection

For the last three months my father has been harrassed by Portfolio Recovery Associates. They claim they purchased a debt of my father's owed to GE Capitol Corp. They will not say what kind of account it was, only that it was opened in January 2006. My father never had any account with GE Capitol Corp. He has never been contacted by them or received an account statement or bill or any request for payment of any kind . Portfolio Recovery refuses to drop this and says he has to pay or file an identity theft report. They have provided him with no information that could enable him to file a police report. They gave him two different addresses for Ge Capitol Corp. He sent a letter to both and received no response. My father is 88 years old and the stress of this is bad for his heart condition. What can I do to get Portfolio Recovery Associates to stop harrassing him over an account he never opened. Any advice will be greatly appreciated.

Re: debt collection

have you obtained a copy of your father's credit report to see if anything appears on his record? the account could have been something else initially and then changed to GE Capital. obtain his credit report and put something in writing to the people calling you or sending you the letters that he does not owe the money and to stop harassing you. by law they are required to provide you with verificationo of the debt, such as a credit card application when the account was opened.

if you need a lawyer's intervention, please contact me.

thanks.
