Neil O'Brien Eaton County Special Assistant Prosecuting Attorney

Criminal Sexual Conduct 3rd Degree or 4th Degree includes sexual penetration (3rd Degree) or sexual contact (4th Degree) between someone who is 16 or 17 years old and a student at a school, and the defendant is a teacher, substitute teacher, school administrator, school employee, contractual service provider of the school, non-student volunteer of the school, or an employee of a unit of government assigned to provide services to the school. CSC 3rd Degree is a 15 year felony, and CSC 4th Degree is a 2 Year circuit court misdemeanor. So, if people fitting these criteria are "dating", they had better be Friends WithOUT Benefits, or else the school-connected adult may become a defendant. Further, that school-connected adult needs to make sure that any internal employee policies, union issues, etc. do not prohibit even F w/o B "dating".
