Legal Question in Family Law in Michigan

if a child tries to committ suicide.....

My son and daughter live with their mother. We both have joint physical custody but my visitation was suspended a few months ago due to a false CSC allegation which has since been dropped. I have yet to get my visitation back legally but my ex wife has let me see the kids a few times regardless. My 13 yr old daughter tried to committ suicide a week ago because she says she hates living with her mother and wants to live with me. Im just wondering if because she tried to harm herself at her mothers, would that help me to get full physical custody? Both my children want to live with me. They are 13 and 11. There mother also has 5 other kids living in that house and I feel she and her husband cannot really afford to care for my children financially with all the other children. Where can I go to get some legal help or advice without paying an arm and a leg for just a consultation? If anybody can help me please feel free. Thank you

A change of custody will only be granted in this case upon a showing that there has been a change in circumstances and that the change in custody is overwhelmingly in the best interest of the child. To best advise you on this matter, you should call my office at (248)851-3171.

You are going to have to file a petition to change custody. You have the burden of proof. Simply because your kids want to live with you will not be sufficient. It is one of the more difficult things to do in the domestic relations area if your ex wants to cause you grief. You really need a good family law lawyer. Unfortunately, it is extremely time consuming and requires some expertise........not necessarily cheap. Talk to a lawyer and see what the cost will be.
