child support for a child father claims is not his

we have been married for 12 years we have a child 5 that husband claims is not his but has been a father too him. Would he have to pay child support for him? He is on the birth ceritciate and has always claimed him untill now we getting a divorce.

To Whom It May Concern:

This is in response to your email dated February 7, 2001, which we received on March 20, 2001.

Under current Michigan law, if the parties signed an acknowledgement of parentage form, paternity is established. Under this premise, a party may be liable for child support.

Most likely yes. Your husband could try and dispute paternity by having a DNA test performed; but, providing he had suspicions before the filing for divorce and refused to act upon them, he should be held as not only the legal father but the de facto father.
