Legal Question in Family Law in Michigan

Demanding the Children Stay Home

Custodial parent(CP) is demanding the children, both young minors, to stay home during the Non-custodial (NCP) parent's visitation. CP demands the children just before arrival of NCP for pick-up. Threats have been made by the CP that if the children do not stay home, the police will be called because they are misbehaving. CP's demands cause the children to cry and are often distraught after arriving at NCP's home, if they come at all. When confronted by the children in the presence of NCP, CP states it's a lie. How can I help the children legally?

Hello, I have received a copy of your postin regarding the custodial parent's treatment of visitation. You need to consult the Friend of the Court in the county where the divorce took place. Consider using the assistance of an attorney. John C. Talpos (http://www.Mich-Lawyer.com) (248) 743-6800

File a motion to put in the visitation arrangement that you have the right to remove the children. If she does not comply, call the police and enforce it. Then, go to court to have her held in contempt for putting the kids through that and violating the court order. Bill Stern 248-353-9400
