Maternal Grandparent Rights

My grandsons father died 4-29-06. My daughter lost custody of my grandson to his father 8 years ago. i have no knowledge of my daughters whereabouts. I have had my grandson since the death of his father.He has no one else to go to. I'd like to know if by me being his maternal grandmother if I have to go through the courts and get some sort of guardianship for him. Or do I naturally have rights as his maternal grandmother to have him medically treated ect. He is fourteen. I'm not concerned with his mother trying to take him, she has children spread all overe that she does not want.

You should retain an experienced family law lawyer to begin proceedings to either adopt your grandson or to obtain a guardianship.

You do not have automatic guardianship rights as a grandparent. You will need to petition the court to get an order saying you are the guardian.
