Legal Question in Family Law in Michigan

Proof of child support expenditures

How do I force my exwife to prove she is spending my child support payments on the children and not on herself? Also can I ask for receipts that she is spending the $300 I give her for COBRA on insurance? How do I go about this? I live in Wayne County, Michigan. Thank you.

Re: Proof of child support expenditures

You can't. The law does not give anyone the authority to verify how child support payments are being spent. Imagine the difficulty of trying to document how much of the child support went towards the water and sewer bill - towards the heat - towards the electric - towards the groceries, etc. If the refrigerator breaks, and needs to be repaired, should your ex be allowed to spend some of that money on the repair? The child needs a refrigerator after all. As long as the child is being taken care of, and has shelter, food, and clothing, your ex does not have to explain anything. If your child is not being taken care of, then you should be taking your ex back to court to seek custody. As far as the $300 for COBRA payments - even if she were pocketing the money, why would it matter? That would mean she is foregoing insurance, which could only hurt her if she were injured or sick - it would not hurt you. It would not be a smart decision on her part (going without insurance.)

Good luck!
