I have been married for 1 1/2 years, I purchased my home soleley prior to meeting my husband(about 2 years) I have never taken any steps to include his name on the title or deed of the home, or changed from my maiden name to married name. Does he have any rights to the property? Also, I have asked him to leave several times for a trial seperation, he still has not gone, do I have any rights to get him out of the home?

If you want him out of the MARITAL HOME, you'll have to divorce him and claim the home as non-marital property.

The two aren't the same and you can't have it both ways. Right now, he has every right to live there.

File for divorce. He may be able to stay for a short time until the divorce is final, unless he causes too much trouble at which time the judge would require him to move. Since you brought the house into the marriage and it is a short term marriage, the great likelihood is that he will not have any rights to the house. Bill Stern 248-353-9400
