Legal Question in Civil Litigation in Michigan

discovery

I filed a subponea order to appear and /or produce in a general civil case. The opposing attorney wrote me that i had to have leave of the court,and that he would not honor subponea. How do i get leave of the court for discovery/

Although you did not say so, I assume that you are in a district court. The other attorney is correct. No discovery in district court unless ordered by the judge. You can file a motion requesting that the court order discovery or take it up at a pre-trial, if they have one. William S. Stern
