Legal Question in Immigration Law in Michigan

legal guardianship and immigration law

My husband and I are interested in obtaining legal

guardianship over our nephew who was born and lives

in Mexico. I am a natural born U.S. citizen and my

husband a Permanent Resident Alien. We would like

to bring our nephew (he is 15 years old) to the U.S. to

provide a better life and education for him. Is this

possible as legal guardians? How do I begin? How

long does it take? If this method is too complicated,

please suggest a better method to use. Our only intent

is to provide a better life and education for our god

child. We'd like to get him in school and possibly a job.

His present living conditions are unhealthy and poor.

He doesn't go to school because he must work to help

his parents make ends meet.

You need to adopt him ASAP!!!Then file I-130 petition for him. You need to show that for last couple of years you have been supporting him as an adoptive parent

Re: legal guardianship and immigration law

You must adopt him and live in his country for two years (or find another basis upon which he can come here and live with you for 2 years) before you can sponsor him. The most important thing is to adopt him now. Once he turns 18, that could be an important turning point.
