Legal Question in Immigration Law in Michigan

The naturalization guide on the 1st top part of requirements states: If you are at least 18 years old and have no special circumstances. In the same guide they mention the rest of the types of applicants (military, international..., as part of other requirements for eligibility but they not described as special circumstances pages 18-23).

How much time a widow (with a Permanent Residence on that basis) should wait (she is not single or remarried but a widow) before submiting the n-400? Is her case considered of special circumstances or not? and Why?

A person who is a widow, and obtained her lawful permanent resident based on marriage to a U.S. citizen may be eligible for "exceptional" circumstances. Normally a person married to a USC and living in "marital union" with the USC may apply after 3 years from obtaining his or her green card. If this widow, however, was living with her spouse for at least 3 years from the time she obtain lpr status, she may be able to claim an exception and apply before the 5 year period. You might want to check with the local USCIS office. Good luck!
