Appeal of Retirement Benefits to Ex-Spouse

My husband divorced his first wife in 1991. During the divorce proceedings, it was decided that the wife would receive 35 percent, at 20 years of military service, of my husband's military retirement. He served a total of 28 years and her retirement amount continued increasing with each year, even after the 20 year mark was reached.

In conjunction with this, the woman is also collecting another military retirement paycheck from her current husband. The woman doesn't work and has been living off my husband since the time they divorced in 1991. Given these unfortunate circumstances, is it possible that my husband could appeal the original divorce decree and get his full retirement benefit back?

Without having all the facts and circumstaces of the divorce decree it is impossible to tell. You need to see an attorney in your jurisdiction who deals in family law. They would be able to tell you the ins and out of the case.
